These Terms & Conditions (“Terms”) govern your use of the website www.patrickbittan.es and participation in services provided by Patrick Bittan Martial Arts Academy Spain (“Academy,” “we,” “us,” or “our”).

By accessing this website or participating in classes, memberships, or services offered by the Academy, you agree to be bound by these Terms.

4. Membership & Class Participation

4.1 Eligibility

Participation in training programs requires that you:

  • Are medically fit to participate in physical activity

  • Provide parental/guardian consent if under 18 years of age

Children under 18 must have written consent from a parent or legal guardian.

4.2 Assumption of Risk

You acknowledge that martial arts training, including Brazilian Jiu-Jitsu, Krav Maga, Muay Thai, and MMA, involves inherent risks of physical injury.

By participating in training:

  • You voluntarily assume all associated risks
  • You accept responsibility for your own health and safety
  • You confirm that you are physically capable of participating

The Academy takes reasonable safety precautions but cannot eliminate all risks.

5. Health & Medical Conditions

You agree to inform the Academy of any:

  • Medical conditions
  • Injuries
  • Physical limitations
  • Pregnancy
  • Any condition that may affect your participation

The Academy reserves the right to refuse participation if deemed unsafe.

You are responsible for obtaining medical clearance where necessary.

6. Payments & Fees

6.1 Fees

All membership fees, class fees, or program fees will be communicated prior to enrolment.

Fees may be subject to change with reasonable notice.

6.2 Payment Terms

  • Payments must be made in advance unless otherwise agreed.
  • Failure to pay may result in suspension or termination of membership.
  • Refund policies (if applicable) will be outlined separately.

Unless required by law, membership fees are non-refundable.

7. Cancellation & Termination

7.1 By the Member

Members may cancel membership in accordance with the cancellation terms agreed upon at enrolment.

Notice periods (if applicable) must be respected.

7.2 By the Academy

The Academy reserves the right to suspend or terminate membership if:

  • A member behaves aggressively or unsafely
  • A member violates Academy rules
  • Fees remain unpaid
  • Conduct damages the reputation or safety of the Academy

No refund will be issued where termination results from breach of conduct.

8. Code of Conduct

All members agree to:

  • Treat instructors and students with respect
  • Follow safety instructions
  • Maintain hygiene standards
  • Use equipment responsibly
  • Avoid aggressive or dangerous conduct outside training guidelines

The Academy reserves the right to remove individuals who fail to adhere to these standards.

9. Photography & Media

The Academy may take photographs or videos during classes, events, or competitions for promotional purposes.

If you do not wish to appear in promotional media, you must notify the Academy in writing.

For minors, parental consent will be obtained where required.

10. Limitation of Liability

To the fullest extent permitted by law, Patrick Bittan Academy Spain shall not be liable for:

  • Personal injury arising from participation in training (except where caused by proven negligence)
  • Loss, theft, or damage of personal belongings
  • Indirect or consequential damages

Nothing in these Terms excludes liability where exclusion is prohibited by Spanish or EU law.

11. Personal Data

Personal data is processed in accordance with our Privacy Policy and in compliance with:

  • Regulation (EU) 2016/679 (GDPR)
  • Spanish data protection laws

By using our services, you consent to data processing as outlined in our Privacy Policy.

12. Force Majeure

The Academy shall not be liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Public health emergencies
  • Strikes or civil disturbances

13. Intellectual Property

All logos, branding, course materials, written content, and training systems remain the intellectual property of Patrick Bittan Academy Spain.

Reproduction or distribution without written consent is prohibited.

14. Amendments

We reserve the right to modify these Terms at any time.

Updated Terms will be published on this website.

Continued use of services constitutes acceptance of updated Terms.

15. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Spain.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
